These Terms of Service (“Terms”) are an agreement between you and Agni, Inc. (“Agni”, “we”, “us”), which operates LightsKiddo: the Mac, iPhone and Android apps, lightskiddo.com, films.lightskiddo.com, app.lightskiddo.com, our plugins for other software, and the services behind them (the “Service”). Questions: info@lightskiddo.com.
By creating an account or using the Service you agree to these Terms, including the Acceptable Use Policy in section 6, and to our Privacy Notice. If you use the Service for a company or a production, you agree on its behalf and confirm you are allowed to.
1. WHO CAN USE LIGHTSKIDDO
You must be 18 or older. Keep your sign-in secure: you are responsible for what happens in your account, and for the people you invite into your projects.
2. YOUR CONTENT
You own what you bring and what you make. Scripts, notes, uploads, voices, recordings, and the images, video, audio and documents you generate (“Your Content”) are yours, to the extent the law allows. In some countries content made by AI is not protected by copyright, so others may be free to copy it.
You let us use it to run the Service. You give Agni a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit and display Your Content, and to send it to the service providers listed in our Privacy Notice, only to provide, secure and support the Service for you and the people you share it with, and to study how the Service is used in de-identified, aggregate form so we can improve it. The licence ends when you delete the content or your account, except for copies the law, safety or a legal claim requires us to keep.
We don’t use Your Content to train general-purpose AI models. When you apply a photo to a character, we build a model of that face only for your project; it is not shared with other customers.
You are responsible for Your Content. You promise that you have every right and permission it needs, including from each person who appears in it or whose likeness or voice you use (section 4), and that it, and the way you use what you generate, doesn’t break the law or anyone’s rights.
3. AI FEATURES
The Service uses AI models run by us and by other companies (listed in our Privacy Notice). Using an AI feature sends the prompts, text, images, audio and project details it needs to those providers.
- AI output can be wrong, surprising, or similar to existing works or real people. Review it before you rely on it or publish it. You decide how to use it and are responsible for that use.
- Providers refuse some requests. A refused or failed job is not charged.
- Images, video and audio generated with LightsKiddo carry metadata that identifies them as AI-generated (anyone can check a file). Don’t remove it.
- If you publish realistic generated content that shows real people, places or events, say that it is AI-generated, as the law in many places (including the EU) requires.
4. REAL PEOPLE: LIKENESS, VOICE AND RECORDINGS
- Only use a real person’s photo, likeness or voice with their permission. Before you apply someone’s photo to a character, use their face as a reference, or clone their voice, get that person’s written consent for that use, unless it’s you.
- Never use the Service to make sexual or intimate images of a real person, to impersonate someone, or to mislead people about what a real person said or did.
- Recording. The apps can record audio and video and stream a camera preview. Many places require everyone being recorded to agree. Telling people and getting their consent is your responsibility.
- Location. Viewfinder stills and previs captures save where they were taken, and your project’s members can see it.
5. TEAMS, SHARING AND STUDIOS
Projects and studios have members with different roles. Whoever owns or administers a project or studio decides who joins and what they can see. Content shared with members stays available to them after you leave. If you keep your clients’ or crew’s personal information in LightsKiddo, you must have a lawful reason to do so; we process it on your behalf, and our data processing terms are available from info@lightskiddo.com.
6. ACCEPTABLE USE POLICY
Don’t use the Service to create, upload, share or request:
- child sexual abuse material, or any sexual content involving minors or people who appear to be minors (we report it to the National Center for Missing & Exploited Children and preserve it as the law requires);
- intimate images shared without consent, or sexual or nude images of a real person;
- content that harasses, threatens, defames or doxxes anyone, or promotes violence, terrorism or violent extremism;
- content that infringes copyright, trademarks, publicity rights or privacy;
- fraud, impersonation, deceptive deepfakes, or election misinformation;
- malware or attacks on the Service, scraping it, or getting around its limits, security or billing.
You also agree to the usage policies of the AI providers we use: Anthropic, OpenAI, fal.ai and ElevenLabs.
We may remove content, refuse requests, and suspend or close accounts that break these rules, and we tell the people affected why unless the law or safety prevents it. If you think we got it wrong, write to info@lightskiddo.com and we will review the decision.
7. REPORTING CONTENT AND COPYRIGHT
Report illegal content, abuse, intimate images shared without consent, copyright infringement and security issues to info@lightskiddo.com. Tell us what it is, where it is (a link or the project and item), why it breaks the law or these Terms, and how to reach you.
- Intimate images shared without consent, real or AI-made: say that the image is of you (or someone you’re authorised to act for) and was shared without consent, and sign the request. We remove it, and copies we can identify, within 48 hours of a valid request.
- Child sexual abuse material: report it to us and to the NCMEC CyberTipline (report.cybertip.org).
- Copyright (DMCA): send our designated agent (Agni, Inc., info@lightskiddo.com) your signature; the work you say is infringed; the material and where it is; your address, phone and email; a statement that you believe in good faith the use isn’t authorised by the owner, its agent or the law; and a statement, under penalty of perjury, that your notice is accurate and that you are, or may act for, the owner. If your material was removed by mistake, send a counter-notice with your signature, the material and where it was, your contact details, a statement under penalty of perjury that it was removed by mistake or misidentification, and your consent to the jurisdiction of the federal court for your district (or Delaware, if you are outside the United States). We restore it in 10 to 14 business days unless the person who complained tells us they have gone to court. We close the accounts of users who repeatedly infringe.
8. PLANS, CREDITS AND BILLING
- Free to start. Creating projects is free. AI features need a plan or an active trial, and credits.
- Plans. A 7-day free trial, then $50 a month; $50 a month; or $500 a year. Prices are in US dollars, plus any applicable taxes. The monthly plan includes $20 of AI credits each month; the annual plan includes $240 of AI credits at the start of each year.
- Automatic renewal. Your plan renews automatically at the end of each month or year, at the price then in effect, until you cancel. A free trial becomes the $50 monthly plan when it ends unless you cancel before then; you won’t be charged during the trial.
- We remind you. When you subscribe we email you these terms and how to cancel. We also email you before a free trial ends, before each annual renewal, and once a year if you’re on the monthly plan. We tell you at least 30 days before any price change, and you can cancel before it applies.
- Cancel any time, online: at lightskiddo.com/billing (Manage subscription & billing), in the Mac app (Account, then Manage subscription), or by emailing info@lightskiddo.com. Cancelling stops future renewals; your plan stays active until the end of the period you’ve paid for.
- Refunds and plan changes. If you’d like a refund or a different plan, contact us at info@lightskiddo.com and we’ll discuss the options with you. Where the law gives you a right to a refund or to withdraw, such as the 14-day withdrawal right of consumers in the EU and UK, we honour it.
- Credits. Each AI job shows an estimated price before you run it and the actual charge when it finishes; the charge is taken from your credits when the job completes. Failed jobs are not charged. If you cancel a job part-way, the work already done is charged. Credits don’t expire while your account is open, can’t be exchanged for cash, and are lost when you delete your account. A job can take your balance below zero; the shortfall comes out of your next credits.
- No surprise back-charges. We charge jobs when they finish. If a billing error means we didn’t, we won’t charge for that job more than 7 days after it finished.
- Payments are processed by Stripe. We don’t store card numbers.
9. CHANGES
We may change, add or remove features. If a change takes away something you pay for, we tell you in advance and you can cancel; contact us about a refund. We may update these Terms; for material changes we notify you at least 30 days before they take effect.
10. OTHER SERVICES AND SOFTWARE
The Service connects to other software (Premiere Pro, DaVinci Resolve, Blender, Nuke and others) and services, whose own terms apply to them. The Service includes open-source software, provided under its own licences.
11. ENDING YOUR ACCOUNT
You can delete your account in the apps at any time. Deleting it cancels your subscription, signs you out everywhere and deletes your account; projects you share stay with their other members. We keep what the law requires (such as billing records) and what we need to handle reports, safety or legal claims. We may suspend or close accounts that break these Terms, with notice where we can.
12. DISCLAIMERS
THE SERVICE AND ALL AI OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ACCURACY. Budgets, schedules, sun and weather information, camera and lens calculations and call sheets are planning aids; check them before you rely on them on set.
13. LIMITATION OF LIABILITY
TO THE EXTENT THE LAW ALLOWS, AGNI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR PRODUCTION TIME, AND OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND US$100. Some places don’t allow these limits; there they apply as far as the law allows. Nothing in these Terms limits liability that the law doesn’t allow to be limited.
14. INDEMNITY, SANCTIONS AND EXPORT
You will defend and indemnify Agni against claims by third parties arising from Your Content or your breach of these Terms, including claims by people whose likeness, voice or work you used. You may not use the Service where US sanctions prohibit it, or if you are on a US restricted-party list.
15. DISPUTES
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute will be decided exclusively by the state or federal courts located in Delaware, and you and Agni consent to their jurisdiction. If you are a consumer in the EU, the UK or another place whose law gives you rights that an agreement can’t take away, you keep those rights and may bring claims in your local courts.
16. GENERAL
These Terms and the Privacy Notice are the whole agreement between you and Agni about the Service. If any part is unenforceable, the rest still applies. We may assign these Terms in a merger, acquisition or sale. Notices to us: info@lightskiddo.com.
